Bankruptcy. Do I still file my tax returns? Yes. Do I get to keep my tax refund? It depends.

A tax refund based on the income you earned right before your filing goes to the estate = you dont get to keep it. But the tax years after the bankruptcy filing, you do get to keep the refund. So, if you think that youre going to file for bankruptcy soon, take a look at your paycheck withholdings. Make sure you're withholding just enough to cover your anticipated tax bill, but not so much so that youd be getting an enormous refund your tax attorney or tax accountant can help here.

FYI: when filing for bankruptcy, you must provide tax returns for periods ending within four years of your case filing date. And you must continue to file timely tax returns after the bankruptcy filing is completed as well. Failure to file returns and/or pay current taxes during your bankruptcy may result in your bankruptcy case being dismissed.
